Terms of Service

1. Introduction

Welcome to Work Tracker: Hours & Mandays ("the App"). These Terms of Service ("Terms") govern your use of our application developed by VP Utils ("we," "us," or "our"). By downloading, installing, or using the App — whether on mobile (iOS, Android), desktop (Windows, macOS, Linux), or web — you agree to be bound by these Terms.

2. Ongoing Development Notice

By using the App, you acknowledge and accept:

• The App may not function as expected at all times
• Features may be added, modified, or removed without prior notice
• Data loss is possible despite our best efforts to prevent it
• On the Free tier, your data is stored locally on your device; you are responsible for protecting it (for example by keeping your device backed up). Premium adds data export and desktop apps, and Pro adds RSA-2048 encrypted cloud sync & backup plus the web app when enabled.

3. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal use across supported platforms (mobile, desktop, and web as permitted by your subscription tier), subject to these Terms.

You may use the App to track any type of work, including billable hours, client projects, and commercial activities. However, you may not redistribute, resell, or commercially exploit the App itself.

You May Not

• Modify, reverse-engineer, or decompile the App
• Copy, distribute, or create derivative works based on the App
• Redistribute or resell the App or access to it
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Remove any copyright or proprietary notices from the App

4. Intellectual Property

All rights, title, and interest in and to the App, including but not limited to its design, code, graphics, and content, are owned by VP Utils and protected by applicable intellectual property laws.

5. Data and Privacy

By default, all data created within the App is stored locally on your device. For free-tier users, we operate on a zero-knowledge basis:

• We do not have access to your work tracking data
• We cannot recover lost data as we do not have copies
• You are solely responsible for backing up your data
• Uninstalling the App may result in permanent data loss

If you subscribe to the Pro plan, you can enable cloud sync & backup. Your work tracking data is then securely encrypted using RSA-2048 with OAEP (Optimal Asymmetric Encryption Padding) and transmitted to our servers to enable synchronization across your devices (mobile, desktop, and web). In this case, we may be able to assist with data recovery. You can disable cloud sync at any time in the app's settings.

Subscription Tiers & Platform Access

• Free: Mobile app with local storage only
• Premium: Adds ad-free experience, data export (CSV/XLSX), and desktop app usage access (Windows, macOS, Linux)
• Pro: Adds RSA-2048 encrypted cloud sync & backup, multiple parallel Workspaces (Spaces, up to 3), web app access, and AI MCP server in desktop versions of the app

Subscriptions are managed through Google Play or the Apple App Store. For more details about data handling, please refer to our Privacy Policy.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF DATA
• UNINTERRUPTED OR ERROR-FREE OPERATION

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VP UTILS SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, or business opportunities
• Damages arising from your use or inability to use the App
• Any amount exceeding the total amount paid by you to us (if any, maximum $10)

8. Third-Party Services

The App uses the following third-party service:

• Google AdMob: For displaying advertisements. Google AdMob is subject to Google's Terms of Service.

We are not responsible for the content of advertisements or any third-party services linked through ads.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms. Your continued use of the App after changes constitutes acceptance of the modified Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.
